Procedure and rights of appeal

The authorisation procedure for a non-local supplier must be carried out by the licensing authority at the place of destination free of charge in a quick and simple procedure (Art. 3 para. 4 IMA).

In order that the individual may claim the rights due to him or her, the Internal Market Act demands that any restrictions on market access be set out in the form of a ruling (Art. 9 para. 1 IMA). The person concerned may appeal against the ruling. ComCo has an independent right of appeal in order to obtain a declaration as to whether a decision restricts access to the market in an unlawful manner (Art. 9 para. 2bis IMA). Cantonal law must provide for at least one form of appeal to an appellate authority independent of the administration (Art. 9 para. 2 IMA).
